Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Kominote community and marketplace platform at www.mykominote.com and the Kominote mobile apps (the “Service”), operated by Kominote. By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service.

2. Your account

You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us immediately of any unauthorized use.

3. Your content

You retain ownership of the content you post (profiles, posts, listings, reviews, messages). By posting, you grant Kominote a non-exclusive, worldwide license to host and display that content solely to operate and promote the Service. You are responsible for your content and must have the rights to share it.

4. Community rules

You agree not to use the Service to:

• Post unlawful, hateful, harassing, misleading, or infringing content.
• Impersonate others or misrepresent your affiliation.
• Spam, scam, or defraud other members.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service.

5. Marketplace

Kominote provides a venue that connects buyers with Haitian-owned businesses, sellers, and professionals. Kominote is not a party to transactions between members. Sellers are responsible for their listings, pricing, fulfillment, and compliance with applicable laws; buyers are responsible for reviewing listings before purchasing. Any dispute over a transaction is between the buyer and the seller, though we may help facilitate a resolution.

6. Payments

Payments are processed by Stripe and are subject to Stripe’s terms. Prices, taxes, shipping, refunds, and cancellations are set by the seller unless stated otherwise. By purchasing, you authorize the applicable charge.

7. Intellectual property

The Service, including its design, logos, and software, is owned by Kominote and protected by intellectual-property laws. You may not copy, modify, or distribute it without permission.

8. Third-party services

The Service integrates third-party providers (including Supabase, Stripe, and Google Sign-In). Your use of those features may be subject to their terms and privacy policies.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that listings or members are accurate or trustworthy.

10. Limitation of liability

To the maximum extent permitted by law, Kominote will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from transactions between members.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or harm the community.

12. Changes to these Terms

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance.
