Copyright, trademark, counterfeit, and infringement reporting procedures
1. Respect for Intellectual Property
Kominote respects intellectual-property rights and expects users, sellers, professionals, and organizations to do the same. Users may not upload, market, sell, distribute, or otherwise use material that unlawfully infringes copyright, trademark, patent, design, publicity, or other proprietary rights.
2. Seller and User Responsibility
Users are responsible for ensuring they have the rights necessary to use product photos, logos, brand names, written content, music, videos, artwork, designs, and other materials they submit.
3. Counterfeit Goods
Counterfeit, replica, or falsely branded goods that infringe trademark rights are prohibited. Kominote may remove listings and restrict sellers where credible evidence of counterfeiting exists.
4. Reporting Alleged Infringement
A rights holder or authorized representative may submit a report containing:
- Contact information for the reporting party.
- Identification of the copyrighted work, trademark, or other right claimed to be infringed.
- Identification and location of the allegedly infringing material on Kominote.
- A good-faith statement that the complained-of use is not authorized by the rights holder, its agent, or law.
- A statement that the information in the notice is accurate and that the reporter is authorized to act for the rights holder.
- A physical or electronic signature or other legally appropriate authentication.
5. Review and Removal
Kominote may remove or restrict material when a report is sufficiently supported or when otherwise appropriate under law or Platform policy. Kominote may request additional information before acting.
6. Repeat Infringers
Kominote may restrict or terminate accounts that repeatedly infringe intellectual-property rights or repeatedly sell counterfeit goods.
7. Counter-Notices and DMCA
For U.S. operations, Kominote should establish a compliant DMCA notice-and-counter-notice procedure and determine whether to designate and register a DMCA agent with the U.S. Copyright Office. The final procedure should be completed by counsel before publication.
8. Trademark and Brand Complaints
Trademark complaints should identify the registered or claimed mark, relevant registration information where applicable, the allegedly infringing use, and why the use is likely to be unauthorized or confusing.
