Rules for businesses and individuals selling products through Kominote

1. Scope

These Marketplace Seller Terms apply to any user who lists, offers, sells, fulfills, or receives payment for products through Kominote. They supplement the Kominote Terms of Service.

2. Seller Eligibility and Onboarding

Kominote may require seller identity, business, tax, payment, banking, or verification information before enabling sales or payouts. Sellers must keep this information accurate and current.

3. Seller Responsibilities

  • Provide truthful business and seller information.
  • Maintain accurate product descriptions, prices, images, variants, inventory, and availability.
  • Sell only lawful products that the seller has the right to sell.
  • Accurately disclose condition, origin, materials, and other material characteristics.
  • Comply with applicable product, labeling, consumer, tax, import/export, and safety laws.
  • Fulfill orders within stated handling times.
  • Provide accurate shipping and tracking information.
  • Respond reasonably to buyer questions, returns, disputes, and support requests.

4. Product Listings

Listings must not be deceptive, misleading, infringing, or materially incomplete. Kominote may remove or restrict listings that violate Platform policies, payment-provider requirements, or law.

5. Seller Fees

At initial launch, the intended standard product marketplace fee is 6% of the applicable transaction amount, subject to the then-current fee schedule shown to the seller. A buyer service fee and configurable minimum fee may also apply. Actual binding fees are those disclosed by Kominote for the transaction.

Fees must be treated as configurable Platform terms and may change prospectively.

6. Non-Refundable Kominote Fees

Kominote platform and marketplace fees are non-refundable by default, except where required by applicable law or expressly authorized by Kominote. A product refund does not automatically reverse Kominote fees.

7. Order Confirmation and Fulfillment

Seller workflow may include New Order, Confirmed, Processing, Ready to Ship, Shipped, In Transit, and Delivered. Sellers must not falsely confirm, ship, or complete an order.

8. Shipping and Tracking

Where tracking is available, sellers must provide accurate carrier, tracking number, service, and shipment date information. If a shipment has no tracking, the seller must accurately identify it as an untracked shipment where the feature is supported.

9. Multi-Vendor Orders

When an order contains products from multiple vendors, each seller is responsible only for its own fulfillment portion. Sellers may access only customer information reasonably necessary for their own transaction and may not use another seller's information.

10. Returns and Refunds

Sellers must honor the return and refund obligations disclosed in their listings and any additional rights required by law. Kominote may facilitate refunds, partial refunds, disputes, or adjustments consistent with Platform policies.

11. Seller Payouts

Successful payment does not necessarily make funds immediately withdrawable. Earnings may remain Pending, Held, Available, Paid, Reversed, or Adjusted. Payout eligibility may depend on fulfillment, delivery, verification, dispute, fraud, chargeback, or other settlement conditions.

12. Prohibited Circumvention

Sellers may not intentionally use Kominote primarily to acquire customers and then move transactions off-platform to avoid applicable Kominote fees. Repeated intentional circumvention may result in restrictions or suspension.

13. Reviews and Reputation

Sellers may not create fake reviews, purchase reviews, threaten users over reviews, or otherwise manipulate reputation. Reviews tied to completed transactions may receive a Verified Purchase designation.

14. Enforcement

Kominote may remove listings, restrict selling, hold payouts where permitted, require additional verification, suspend accounts, or terminate seller access for fraud, prohibited items, repeated fulfillment failures, policy violations, or legal requirements.
